The precise delineation of the scope of contractual and tortious liability is a crucial element of contractual justice, significantly impacting the compensation for aggrieved parties. The primary question of this research lies in the ambiguity surrounding the distinction or unity of the nature of contractual and tortious liability in Imami jurisprudence and the legal systems of Iran, Egypt, Lebanon, and Iraq. Utilizing a descriptive-analytical and comparative approach, this study examines the role of the authority of will in distinguishing between contractual and tortious liability within these legal frameworks. The findings reveal that recognizing the authority of will in contractual liability can provide a suitable approach for achieving contractual justice and protecting the rights of the injured parties. In Imami jurisprudence, a clear distinction between contractual and tortious liability is acknowledged, with an emphasis on the sovereignty of will in contractual obligations. Similarly, the legal systems of Iran, Egypt, Lebanon, and Iraq agree on this distinction. Considering the doctrinal and legal foundations, along with the needs and exigencies of economic activities, it appears that a unified approach to the nature of contractual and tortious liability, emphasizing the role of the authority of will in determining the extent and manner of compensation, can best serve the interests of contracting parties as well as public order.
