تعاملات بیمه و قانون به مثابه ابزار حکمرانی با تأکید بر بیمه تکافل در حقوق مالزی

چکیده

این مطالعه به بررسی نقش تحول‌آفرین بیمه در حکمرانی مدرن و تحلیل ابعاد حقوقی و اجتماعی آن می‌پردازد. هدف پژوهش، نشان دادن چگونگی تغییر ماهیت بیمه از یک ابزار مبتنی بر حقوق قراردادهای خصوصی به ابزاری مؤثر در حکمرانی اجتماعی است. این تحقیق با تأکید بر توسعه تاریخی بیمه، به کارکردهای اجتماعی نوظهور آن پرداخته و ظرفیت آن را برای کاهش نابرابری‌های اجتماعی و مدیریت ریسک‌های عمومی مورد بررسی قرار می‌دهد. روش پژوهش مبتنی بر تحلیل نظری و کیفی با مروری جامع بر آموزه‌های حقوقی، تحولات تاریخی و مطالعات جامعه‌شناسی حقوق است. در این راستا، بیمه به‌عنوان متغیری کلیدی در تقاطع حقوق قراردادها، مسئولیت‌پذیری و حکمرانی عمومی بررسی شده است. تحلیل کیفی آرای قضایی و چارچوب‌های تنظیم‌گری نیز برای تبیین نقش بیمه در انسجام اجتماعی و حکمرانی مورد استفاده قرار گرفته است. یافته‌های پژوهش نشان می‌دهد که بیمه از طریق مدیریت ریسک و توزیع مسئولیت‌ها، نقشی کلیدی در شکل‌دهی به ساختارهای اجتماعی و حقوقی ایفا می‌کند. بیمه با عملکردی تنظیم‌گر، دسترسی به منابع اجتماعی و اقتصادی را بهبود می‌بخشد و در حل‌وفصل دعاوی مدنی نقش بسزایی دارد. همچنین این مطالعه به بررسی نقش دوگانه بیمه به‌عنوان یک قرارداد حقوقی و ابزاری سیاسی‌اجتماعی پرداخته و ظرفیت آن برای یکپارچه‌سازی سازوکارهای بخش خصوصی در حکمرانی عمومی را نشان می‌دهد. در این تحقیق تمرکز بر مطالعه بیمه تکافل در کشور مالزی خواهد بود. نتیجه‌گیری پژوهش بر اهمیت تعامل میان بیمه و قانون در تقویت حکمرانی اجتماعی مؤثر تأکید دارد. بیمه با بازتعریف چارچوب‌های حقوقی و ترویج همبستگی اقتصادی، به‌عنوان ابزاری مقرون‌به‌صرفه برای مقابله با چالش‌های اجتماعی پیچیده ظاهر شده و ابزارهایی عملی برای سیاست‌گذاران و متخصصان حقوقی فراهم می‌آورد.

This study examines the transformative role of insurance in modern governance, focusing on its legal and social dimensions. The aim is to explore how the nature of insurance has shifted from a tool rooted in private contract law to an effective mechanism in social governance. Emphasizing the historical development of insurance, this research investigates its emerging social functions and its potential to reduce social inequality and manage public risks. The research method is based on theoretical and qualitative analysis, involving a comprehensive review of legal doctrines, historical developments, and socio-legal studies. Insurance is analyzed as a key variable at the intersection of contract law, accountability, and public governance. Qualitative analysis of judicial opinions and regulatory frameworks is also employed to highlight the role of insurance in fostering social cohesion and governance. Findings indicate that insurance, by managing risks and distributing responsibilities, plays a crucial role in shaping social and legal structures. With its regulatory function, insurance enhances access to social and economic resources and contributes significantly to civil dispute resolution. The study also examines the dual nature of insurance—as a legal contract and a socio-political instrument—revealing its capacity to integrate private sector mechanisms into public governance. The research particularly focuses on the Takaful insurance model in Malaysia. The conclusion underscores the importance of law–insurance interaction in reinforcing effective social governance. By redefining legal frameworks and promoting economic solidarity, insurance has emerged as a cost-effective tool for addressing complex social challenges and offers practical mechanisms for policymakers and legal professionals.

نتیجه‌گیری

این پژوهش نشان داد که بیمه در حقوق معاصر صرفاً یک قرارداد خصوصی برای جبران خسارت نیست، بلکه به سازوکاری نهادمند برای حکمرانی ریسک تبدیل شده است. تعامل قانون و بیمه امکان نوعی تنظیم‌گری غیرمستقیم را فراهم می‌کند که از طریق تولید دانش ریسک، شرط‌گذاری، قیمت‌گذاری و توزیع مسئولیت، رفتارهای اجتماعی و اقتصادی را هدایت می‌نماید.

تحلیل نظری مقاله نشان داد بیمه از سه مسیر اصلی کارکرد حکمرانی می‌یابد: نخست، استانداردسازی و محاسبه‌پذیر کردن ریسک؛ دوم، ایفای نقش دروازه‌بان در دسترسی به فعالیت‌ها و منابع؛ و سوم، بازآرایی عملی نظام مسئولیت مدنی. در این چارچوب، عدالت اجتماعی نتیجه خودکار بیمه نیست، بلکه وابسته به طراحی حقوقی و نحوه تنظیم‌گری آن است.

مطالعه تطبیقی مالزی نشان داد تکافل زمانی به ابزار حکمرانی مؤثر تبدیل می‌شود که چارچوب قانونی شفاف، حکمرانی شرعی نهادمند و هم‌راستاسازی صنعت با اهداف اجتماعی (مانند شمول مالی و کاهش شکاف پوشش) به‌صورت هم‌زمان برقرار باشد. تجربه مالزی بیانگر آن است که بیمه اسلامی، در صورت برخورداری از معماری نهادی منسجم، می‌تواند در حوزه‌هایی چون حمایت از مشاغل غیررسمی، مدیریت ریسک بلایای طبیعی و تقویت تاب‌آوری اجتماعی نقش تنظیم‌گر ایفا کند.

برای نظام حقوقی ایران، دلالت اصلی این پژوهش آن است که بیمه باید در سیاست‌گذاری عمومی به‌عنوان ابزار حکمرانی ریسک بازتعریف شود. این امر مستلزم هماهنگی نهادی میان قانون‌گذار، نهاد ناظر و مراجع فقهی، طراحی سازوکارهای پوشش ریسک‌های بزرگ ملی، توسعه حمایت بیمه‌ای از مشاغل پرریسک و تنظیم قواعد شفاف در حوزه بیمه دیجیتال است.

درنهایت، حکمرانی از طریق بیمه زمانی مشروع و کارآمد خواهد بود که میان کارایی اقتصادی، پاسخگویی نهادی و عدالت اجتماعی توازن برقرار گردد. چالش پیش‌روی حقوق ایران نه صرف گسترش بازار بیمه، بلکه طراحی معماری هوشمندانه حکمرانی بیمه‌ای است.
