Polygamy refers to having more than one spouse. When this term is associated with marriage, it denotes having more than one wife. Islamic law has restricted polygamy to two conditions: first, observing justice among wives, and second, having the financial capability to provide for the maintenance and management of the women under one’s care. Islamic jurists unanimously agree on the permissibility and legitimacy of polygamy. This phenomenon has positive aspects, including the realization of religious benefits, the formation of a family filled with affection and mercy, addressing the need for population growth, and alleviating certain social problems. However, the application of polygamy comes with challenges, such as injustice and discrimination among wives, financial incapacity, and psychological distress in children.There is no uniform stance on polygamy in the personal status laws of Islamic countries. In some Islamic countries, polygamy is entirely prohibited, legally invalid, and punishable by law. In others, marrying more than one woman is not permitted without court approval. Meanwhile, in some Islamic countries, remarriage is allowed under specific conditions. In most Islamic countries, polygamy is accepted based on jurisprudential reasoning and the established practice of Muslims.This study, through the description and analysis of jurisprudential and legal propositions, examines and critiques the aforementioned positions and their arguments. Ultimately, it defends the legitimacy and permissibility of polygamy and its positive impact on family stability, considering it consistent with the explicit meaning of religious texts.
