The position of verse 21 of Surah Ar-Rum (the verse of affection and mercy) in jurisprudential inference

Abstract

Despite the small number of jurisprudential verses of the Quran, from the point of view of renowned Islamic scholars, the Holy Quran is considered the most important source in the process of ijtihad by both sects. One of the objections to the consensus in Imami jurisprudence is the lack of attention to the Holy Quran in inference. The present article is a monograph of the author's grand design, which has made the examination of the reference to the Quran by jurists in verses related to the vital issue of the family the focus of his efforts. In this article, by referring to the heritage of Islamic jurisprudence, especially Imami jurisprudence from the beginning to the present time, we have tried to show the serious attention of Islamic jurists to the Holy Quran in important issues of family jurisprudence, which is derived from verse 21 of Surah Ar-Rum, by introducing subsidiary rulings such as: the impermissibility of marriage with a non-Muslim and the failure to implement the hadd qat in the theft of each other's property by spouses, and to pave the way for a more real and non-slogan presence of this holy book in jurisprudential inference.holy book in jurisprudential inference
